Legal Protections for Maine Servicemembers
SCRA Lease Termination
Servicemembers on active duty who receive PCS orders or deployment orders for a period of 90 days or more have the right to terminate a residential lease under the Servicemembers Civil Relief Act. To exercise this right, you must provide your landlord with written notice of termination and a copy of your military orders. The termination becomes effective 30 days after the next rent payment date following the notice. Landlords in Maine cannot charge early termination fees or penalize servicemembers for exercising their SCRA lease termination rights.
SCRA Interest Rate Cap
The SCRA caps interest rates on debts incurred before active duty service at 6% per year while the servicemember remains on active duty. This applies to credit card debt, auto loans, mortgages, and other pre-service obligations. To invoke this benefit, provide your lender with written notice and a copy of your orders. The lender is required to retroactively apply the 6% cap from the date active duty began.
SCRA Civil Court Protections
Servicemembers who are unable to appear in civil court proceedings due to military service may request a stay of proceedings. Courts may delay civil actions against servicemembers for the duration of their service and for a period afterward. The SCRA also prohibits default judgments against servicemembers without the court first appointing an attorney to represent the servicemember's interests, and it restricts certain eviction proceedings.
SCRA Auto Insurance
The SCRA provides protections related to automobile insurance policies. Insurers cannot cancel or refuse to reinstate a policy solely because the servicemember has been called to active duty. Servicemembers who store a vehicle while deployed and suspend coverage cannot be penalized or have their rates increased upon reinstatement due to the gap in coverage.
UOCAVA Absentee Voting in Maine
Maine fully supports the Uniformed and Overseas Citizens Absentee Voting Act. Servicemembers, their dependents, and overseas citizens can register to vote and request an absentee ballot regardless of where they are stationed. Maine is required to transmit absentee ballots to UOCAVA voters at least 45 days before a federal election. The Federal Voting Assistance Program at vote.gov provides tools and forms for Maine UOCAVA voters.
Additional State Protections
Maine does not currently have additional state-level SCRA enhancements beyond the federal statute.
