Maine Military Tax Benefits

Military Retirement and Pension Income

Maine provides a full exemption from state income tax for all military retirement and pension income. There is no dollar cap, no phase-in period, and no restriction based on branch of service. Whether you retired from active duty, the National Guard, or the Reserves, your retired pay is entirely excluded from Maine taxable income. This exemption took effect following legislative action to support Maine veteran retention and recruitment, and it remains one of the strongest military retiree benefits in the Northeast.

Active Duty Pay

Active duty pay is exempt from Maine income tax when the servicemember is stationed outside of Maine. If you are stationed in Maine and Maine is your legal domicile, regular state income tax applies to your active duty base pay. Allowances such as BAH and BAS are generally not subject to state income tax. Servicemembers should consult Maine Revenue Services or a military tax advisor to confirm their specific situation, particularly when domicile and duty station differ.

VA Disability Compensation

VA disability compensation is not subject to Maine state income tax. This exclusion is consistent with federal law, which prohibits states from taxing VA disability payments. Veterans receiving any rating level of VA compensation can exclude that income from their Maine return entirely.

Veterans Property Tax Exemption

Maine provides a property tax assessed value reduction for qualifying veterans. Most veterans who served during a recognized war period or received an expeditionary medal are eligible for a $6,000 reduction in the assessed value of their primary residence. Veterans with a service-connected paraplegic disability qualify for a substantially larger $50,000 assessed value reduction. Surviving spouses of qualifying veterans may also be eligible for the standard exemption. Applications are filed with the local municipality assessor and must typically be submitted by April 1 for the upcoming tax year. Some municipalities offer additional local exemptions beyond the state minimums.

Estate and Inheritance Tax

Maine imposes a state estate tax on estates above the exemption threshold, but there is no specific military exemption from this tax. Veterans and military families with estates subject to Maine estate tax should consult an estate planning attorney familiar with Maine law.

Education and Licensing Benefits in Maine

Dependent Tuition Waiver

Maine provides a tuition waiver at Maine public colleges and universities for dependents of veterans who died as a result of service-connected causes or who were rated 100% permanently disabled due to a service-connected disability. This benefit is designed to ensure that the children and qualifying dependents of Maine's most severely injured or killed veterans have access to higher education without the burden of tuition costs. Eligible institutions include the University of Maine System campuses and Maine community colleges. Applicants should contact the Maine Bureau of Veterans' Services at 207-430-6035 to begin the eligibility verification process.

Yellow Ribbon Program

Several Maine private colleges and universities participate in the VA Yellow Ribbon Program, which provides additional tuition funding beyond the Post-9/11 GI Bill cap. For veterans attending a participating institution, the Yellow Ribbon Program can fund tuition and fee costs that exceed the GI Bill maximum. Contact the financial aid office of your intended institution to confirm current Yellow Ribbon participation and available funding amounts.

Maine National Guard Tuition Assistance

Members of the Maine National Guard may be eligible for state tuition assistance covering coursework at Maine public colleges and universities. Benefit amounts and eligibility requirements can change based on legislative appropriations. Guard members should contact the Maine National Guard Education Office at 207-430-5891 for the most current information on available funding, credit hour limits, and application deadlines.

Military Spouse Professional License Reciprocity

Maine has enacted expedited professional license reciprocity for military spouses. If you hold a current, valid license in another state for a profession regulated in Maine, you can apply for a Maine license without completing additional education programs or retaking licensing examinations in most cases. This benefit covers a wide range of licensed professions including healthcare, legal, education, and skilled trades. The Maine Department of Labor coordinates the expedited process. Contact them at 207-623-7900 or visit the Maine licensing agency governing your specific profession to begin your application.

GI Bill at Maine Institutions

All University of Maine System campuses and Maine community colleges are approved for GI Bill benefits. Veterans using the Post-9/11 GI Bill (Chapter 33) at Maine public institutions may receive full tuition and fees coverage, a monthly housing allowance based on the BAH rate for the school's zip code, and an annual book stipend. Veterans attending private Maine institutions may also use GI Bill benefits, subject to the applicable private school cap. The Maine Bureau of Veterans' Services can provide referrals to School Certifying Officials at Maine institutions.

SCRA Lease Termination

Servicemembers on active duty who receive PCS orders or deployment orders for a period of 90 days or more have the right to terminate a residential lease under the Servicemembers Civil Relief Act. To exercise this right, you must provide your landlord with written notice of termination and a copy of your military orders. The termination becomes effective 30 days after the next rent payment date following the notice. Landlords in Maine cannot charge early termination fees or penalize servicemembers for exercising their SCRA lease termination rights.

SCRA Interest Rate Cap

The SCRA caps interest rates on debts incurred before active duty service at 6% per year while the servicemember remains on active duty. This applies to credit card debt, auto loans, mortgages, and other pre-service obligations. To invoke this benefit, provide your lender with written notice and a copy of your orders. The lender is required to retroactively apply the 6% cap from the date active duty began.

SCRA Civil Court Protections

Servicemembers who are unable to appear in civil court proceedings due to military service may request a stay of proceedings. Courts may delay civil actions against servicemembers for the duration of their service and for a period afterward. The SCRA also prohibits default judgments against servicemembers without the court first appointing an attorney to represent the servicemember's interests, and it restricts certain eviction proceedings.

SCRA Auto Insurance

The SCRA provides protections related to automobile insurance policies. Insurers cannot cancel or refuse to reinstate a policy solely because the servicemember has been called to active duty. Servicemembers who store a vehicle while deployed and suspend coverage cannot be penalized or have their rates increased upon reinstatement due to the gap in coverage.

UOCAVA Absentee Voting in Maine

Maine fully supports the Uniformed and Overseas Citizens Absentee Voting Act. Servicemembers, their dependents, and overseas citizens can register to vote and request an absentee ballot regardless of where they are stationed. Maine is required to transmit absentee ballots to UOCAVA voters at least 45 days before a federal election. The Federal Voting Assistance Program at vote.gov provides tools and forms for Maine UOCAVA voters.

Additional State Protections

Maine does not currently have additional state-level SCRA enhancements beyond the federal statute. However, servicemembers stationed at Portsmouth Naval Shipyard or elsewhere in Maine who have questions about their legal rights should contact the JAG legal assistance office at PNSY at 207-438-1553. JAG attorneys provide free legal assistance to active duty servicemembers and their families on a wide range of civil legal matters.
